Western Australian 188 Visa Nomination requirements

Western Australia has no limitations beyond the Department of Home Affairs requirements for investors emigrating to Australia.

To award a person an Invitation to emigrate. Western Australia will need to be satisfied that the investor and their family intend to live in Western Australia and that their presence in WA will benefit the local community and economy equally.

1) Business Innovation & Investment Stream

The minimum requirements are the same as the DHA criteria:

  • submit a business proposal with their visa subclass 188 application which includes a detailed budget with costings to substantiate the net assets in business, new employment and total net assets in Western Australia for inclusion in their State nomination agreement for their visa subclass 888 application
  • the business proposal must demonstrate how the business will contribute positively to the Western Australian economy and create jobs
  • applicants and any family members (dependents) residing in Australia are required to live, work and/or study in Western Australia.

2) A$2.5m Investor stream

  • propose net assets of at least $2.5 million invested in complying investments as specified by the DHA
  • agree to re-invest the $2.5 million complying investments into any Western Australian assets upon maturity of the complying investment
  • applicants and any family members (dependents) residing in Australia are required to live, work and/or study in Western Australia.

3) A$5m Investor stream

  • propose net assets of at least $5 million invested in complying investments as specified by the DHA
  • agree to re-invest the $5 million complying investments into any Western Australian assets upon maturity of the complying investment
  • applicants and any family members (dependents) residing in Australia are required to live, work and/or study in Western Australia.

4) Entrepreneur stream

Unlike other states and the Department of Home Affairs. Western Australia has not provided any details on how they wish to attract or assess potential start-up companies. That does not mean the door is open to all comers. In fact, it means the absolute opposite.

Notes:

Western Australia does not allow “Recycling of business” for emigration purposes. Therefore, if a business has previously been used by another business migrant to obtain permanent residency in Australia. It cannot be used again.

Applicants are assessed on a competitive basis and need to submit a minimum proposal for:

  • Business Innovation Stream – Net assets in WA of at least $1,500,000, of which at least $500,000 is invested in the business and the creation of the equivalent of one new full-time job.
  • A$2.5m Investor Stream – Complying investments of $2,500,000 plus an additional $1,250,000 in net assets in Western Australia.
