An Ocean Apart. Not For Long.

The offshore 309/100 pathway reunites you with your Australian partner, permanently, and on Australian soil.

Offshore Partner Visas (309/100): The Complete Reunion Guide

Time zones, video calls and airport goodbyes are no way to run a marriage. The offshore partner pathway (Subclass 309 leading to 100) exists to end exactly that: lodged from outside Australia, it delivers your reunion on Australian soil with permanent residency to follow.

Offshore lodgement changes the strategy, the waiting experience and the evidence. Here is the complete guide for couples applying from abroad in 2026.

Inside the 309/100: Reuniting Couples on Australian Soil

Like its onshore twin, the offshore route is one application, assessed twice:

  • Subclass 309: the temporary provisional visa, letting you enter and live in Australia with work rights
  • Subclass 100: the permanent stage, normally assessed from two years after lodgement

You apply from outside Australia, and the 309 is granted while you are offshore. From the moment you land you can work, study, and enrol in Medicare, and couples together three or more years (or two with a child) are frequently granted the permanent 100 straight away.

The strategic beauty of the offshore route: your Australian partner can go home first, re-establish the household and career, and your arrival lands into a ready-made life.

The tests are the classic partner trio:

  • The relationship: genuine, continuing and exclusive; married, registered, or de facto with usually 12 months of shared life. Married couples can apply even while living in different countries, provided the relationship evidence holds
  • You: outside Australia at lodgement and grant, meeting health and character requirements
  • Your sponsor: an Australian citizen, permanent resident or eligible NZ citizen, with no disqualifying sponsorship history

Distance is not a disqualifier, but it reshapes the evidence. Couples living apart must document commitment across the separation: communication, visits, shared plans and finances that bridge the gap.

The four pillars still decide the case, adapted for couples divided by geography:

  • Financial: transfers between you, shared savings toward the move, joint commitments even at distance
  • Household: the households you have shared, and the concrete plans for the one you will share in Australia
  • Social: visits documented with passports and photographs, families who know you as a couple, joint invitations across two countries
  • Commitment: the daily fabric of long-distance love: calls, messages, plans made and kept across the separation

Offshore refusals almost always trace to evidence that stopped when the couple was separated. We build files that prove the relationship never paused, only the geography did.

The offshore sequence, done properly:

  1. Lodge from outside Australia with a decision-ready file: since April 2026 you should expect only one opportunity to add missing evidence
  2. Continue your life, and your visits. You can visit Australia while the 309 processes on an ordinary visitor visa, but must be offshore for grant
  3. Grant and arrival: enter Australia, work from day one, enrol in Medicare
  4. The permanent 100: updated evidence from two years after lodgement, or immediately for long-established couples

Compare the other road in our onshore 820/801 guide; the right choice depends on where your lives, jobs and family sit today.

Cost: AUD 11,710 for the primary applicant from 1 July 2026, covering both the 309 and 100 stages, plus AUD 5,860 per additional adult and AUD 2,935 per child.

Processing: around half of offshore cases are decided within 14 months (measurably faster than the onshore median) with nine in ten finalised inside roughly two years.

The reunion dividend: because the Australian partner can re-establish first, offshore couples often land into housing, schools and work already arranged, turning the visa wait into a head start.

Your 309/100 Document Checklist: Built Across Two Countries

Certified passports and birth certificates for both partners, marriage certificate or relationship registration, evidence ending previous relationships, and name-change documents, plus your sponsor’s citizenship or PR evidence.

The four-pillar file adapted for distance: visit records (passport stamps, boarding passes, photographs), communication logs across the separation, financial transfers and shared savings, statements from family and friends in both countries, and your concrete plans for the shared Australian household.

Sponsorship application, sponsor police certificates, and previous sponsorship disclosure, with the sponsor’s Australian re-establishment (housing, work) documented where it strengthens the settlement story.

Immigration medical examinations with an approved panel physician in your country of residence, booked to instruction so validity carries to grant.

Police certificates from every country of 12+ months residence in the past decade since turning 16, sequenced early, since offshore applicants often need certificates from multiple jurisdictions.

Offshore Partner Visa FAQs Answered by Former Immigration Officials

They are two stages of one application: the 309 is the temporary visa that brings you to Australia; the 100 is the permanent stage, normally assessed from two years after lodgement, or immediately for long-established couples.

Yes. Married couples especially can apply while living apart, provided the evidence shows the relationship continuing across the distance: visits, communication, finances and shared plans.

Generally yes, on a visitor visa, but you must be outside Australia when the 309 is granted. We time travel plans around the expected decision window.

Around half of 309 applications are decided within 14 months (faster than the onshore median) with most finalised inside two years.

AUD 11,710 from 1 July 2026 for the primary applicant, covering both stages, plus AUD 5,860 per additional adult and AUD 2,935 per child.

Yes. The 309 carries full work rights from the day you enter Australia, along with Medicare enrolment eligibility.

It depends where your lives sit today: onshore suits couples already together in Australia; offshore suits couples apart, letting the Australian partner re-establish first. Our assessment maps both against your circumstances.

You may receive the permanent 100 at the same time as the 309: one decision, permanent residency on arrival.

Yes. Dependent children are included in the application and receive the same visa and pathway to permanent residency.
